Regulamin Sklepu Internetowego – www.lazydaisy.eu

I. Postanowienia ogólne

  1. Niniejszy Regulamin określa ogólne warunki, sposób świadczenia usług drogą elektroniczną i sprzedaży prowadzonej za pośrednictwem Sklepu Internetowego www.lazydaisy.eu. Sklep prowadzi Katarzyna Krajewska-Sycz prowadząca działalność gospodarczą pod firmą POLKA Katarzyna Krajewska-Sycz wpisaną do rejestru przedsiębiorców Centralnej Ewidencji i Informacji o Działalności Gospodarczej prowadzonej przez Ministra Rozwoju, pod adresem ul. Łokietkówny 7/9 92-418 Łódź, NIP:7282556627, REGON:100690800, zwany dalej Sprzedawcą.
  2. Kontakt ze Sprzedawcą odbywa się poprzez:
    1. adres poczty elektronicznej: kontakt@lazydaisy.eu,
    2. formularz kontaktowy dostępny na stronie internetowej Sklepu,
    3. pod numerem telefonu: +48 515 106 188.
  3. Niniejszy Regulamin jest nieprzerwanie dostępny w witrynie internetowej www.lazydaisy.eu, w sposób umożliwiający jego pozyskanie, odtwarzanie i utrwalanie jego treści poprzez wydrukowanie lub zapisanie na nośniku w każdej chwili.
  4. Sprzedawca informuje, że korzystanie z usług świadczonych drogą elektroniczną może wiązać się z zagrożeniem po stronie każdego użytkownika sieci Internet, polegającym na możliwości wprowadzenia do systemu teleinformatycznego Klienta szkodliwego oprogramowania oraz pozyskania i modyfikacji jego danych przez osoby nieuprawnione. By uniknąć ryzyka wystąpienia zagrożeń w/w Klient powinien stosować właściwe środki techniczne, które zminimalizują ich wystąpienie, a w szczególności programy antywirusowe i zaporę sieciową typu firewall.

II. Definicje

Użyte w Regulaminie pojęcia oznaczają:

  1. Dni robocze – są to dni od poniedziałku do piątku z wyłączeniem dni ustawowo wolnych od pracy;
  2. Klient – osoba fizyczna, która posiada pełną zdolność do czynności prawnych, osoba fizyczna prowadząca działalność gospodarczą, osoba prawna lub jednostka organizacyjna nie będącą osobą prawną, której przepisy szczególne przyznają zdolność prawną, która dokonuje Zamówienia w ramach Sklepu Internetowego lub korzysta z innych Usług dostępnych w Sklepie Internetowym;
  3. Kodeks Cywilny – ustawa z dnia 23 kwietnia 1964 r. (Dz. U. Nr 16, poz. 93 ze zm.);
  4. Konsument – Klient będący konsumentem w rozumieniu art. 22[1] Kodeksu cywilnego;
  5. Przedsiębiorca – Klient będący przedsiębiorcą w rozumieniu art. 43[1] Kodeksu cywilnego;
  6. Regulamin – niniejszy dokument;
  7. Towar – produkt prezentowany w Sklepie Internetowym, którego opis jest dostępny przy każdym z prezentowanych produktów;
  8. Umowa sprzedaży – Umowa sprzedaży Towarów w rozumieniu Kodeksu Cywilnego, zawarta pomiędzy Sprzedawcą a Klientem;
  9. Usługi – usługi świadczone przez Sprzedawcę na rzecz Klientów drogą elektroniczną w rozumieniu przepisów ustawy z dnia 18 lipca 2002 roku o świadczeniu usług drogą elektroniczną (Dz.U. nr 144, poz. 1204 ze zm.);
  10. Ustawa o prawach konsumenta – ustawa z dnia 30 maja 2014 r. o prawach konsumenta (Dz. U. 2014, Nr 827);
  11. Ustawa o świadczeniu usług drogą elektroniczną – ustawa z dnia 18 lipca 2002 r. o świadczeniu usług drogą elektroniczną (Dz. U. Nr 144, poz. 1204 ze zm.);
  12. Zamówienie – oświadczenie woli Klienta, zmierzające bezpośrednio do zawarcia Umowy sprzedaży, określające w szczególności rodzaj i liczbę Towaru.

III. Zasady korzystania ze Sklepu Internetowego

  1. Korzystanie ze Sklepu Internetowego jest możliwe pod warunkiem spełnienia przez system teleinformatyczny, z którego korzysta Klient, następujących minimalnych wymagań technicznych:
    1. komputer lub urządzenie mobilne z dostępem do Internetu,
    2. dostęp do poczty elektronicznej,
    3. przeglądarka internetowa Internet Explorer w wersji 11 lub nowszej, Firefox w wersji 28.0 lub nowszej, Chrome w wersji 32 lub nowszej, Opera w wersji 12.17 lub nowszej, Safari w wersji 1.1. lub nowszej,
    4. włączenie w przeglądarce internetowej Cookies oraz Javascript.
  2. Korzystanie ze Sklepu Internetowego oznacza każdą czynność Klienta, która prowadzi do zapoznania się przez niego z treściami zawartymi w Sklepie.
  3. Klient zobowiązany jest w szczególności do:
    1. niedostarczania i nieprzekazywania treści zabronionych przez przepisy prawa, np. treści propagujących przemoc, zniesławiających lub naruszających dobra osobiste i inne prawa osób trzecich,
    2. korzystania ze Sklepu Internetowego w sposób niezakłócający jego funkcjonowania, w szczególności poprzez użycie określonego oprogramowania lub urządzeń,
    3. niepodejmowania działań takich jak: rozsyłanie lub umieszczanie w ramach Sklepu Internetowego niezamówionej informacji handlowej (spam),
    4. korzystania ze Sklepu Internetowego w sposób nieuciążliwy dla innych Klientów oraz dla Sprzedawcy,
    5. korzystania z wszelkich treści zamieszczonych w ramach Sklepu Internetowego jedynie w zakresie własnego użytku osobistego,
    6. korzystania ze Sklepu Internetowego w sposób zgodny z przepisami obowiązującego na terytorium Rzeczypospolitej Polskiej prawa, postanowieniami Regulaminu, a także z ogólnymi zasadami korzystania z sieci Internet.
  4. Sprzedawca ma prawo do organizowania okazjonalnych konkursów i promocji, których warunki każdorazowo zostaną podane na stronach internetowych Sklepu. Promocje w Sklepie Internetowym nie podlegają łączeniu, o ile Regulamin danej promocji nie stanowi inaczej.
  5. W przypadku naruszenia przez Klienta postanowień niniejszego Regulaminu, Sprzedawca po uprzednim bezskutecznym wezwaniu do zaprzestania lub usunięcia naruszeń, z wyznaczeniem stosownego terminu, może rozwiązać umowę o świadczenie Usług z zachowaniem 14-dniowego terminu wypowiedzenia.

IV. Procedura zawarcia Umowy sprzedaży

  1. Informacje o Towarach podane na stronach internetowych Sklepu, w szczególności ich opisy, parametry techniczne i użytkowe oraz ceny, stanowią zaproszenie do zawarcia Umowy, w rozumieniu art. 71 Kodeksu Cywilnego.
  2. Wszystkie Towary dostępne w Sklepie Internetowym są fabrycznie nowe, wolne od wad fizycznych i prawnych oraz zostały legalnie wprowadzone na rynek polski.
  3. Warunkiem złożenia Zamówienia jest posiadanie aktywnego konta poczty elektronicznej.
  4. W przypadku składania Zamówienia poprzez formularz Zamówienia dostępny na stronie internetowej Sklepu Internetowego, Zamówienie zostaje złożone Sprzedawcy przez Klienta w formie elektronicznej i stanowi ofertę zawarcia Umowy sprzedaży Towarów będących przedmiotem Zamówienia. Oferta złożona w postaci elektronicznej wiąże Klienta, jeżeli na podany przez Klienta adres poczty elektronicznej Sprzedawca prześle potwierdzenie przyjęcia do realizacji Zamówienia, które stanowi oświadczenie Sprzedawcy o przyjęciu oferty Klienta i z chwilą jej otrzymania przez Klienta zawarta zostaje Umowa sprzedaży.
  5. Złożenie Zamówienia w Sklepie Internetowym poprzez przesłanie wiadomości elektronicznej następuje w Dniach roboczych oraz godzinach wskazanych na stronie internetowej Sklepu Internetowego. W tym celu Klient powinien:
    1. podać w treści wiadomości elektronicznej kierowanej do Sprzedawcy nazwę Towaru spośród Towarów znajdujących się na stronie internetowej Sklepu i jego ilość,
    2. wskazać sposób dostawy i formę płatności spośród sposobów dostawy i płatności podanych na stronie internetowej Sklepu,
    3. podać dane potrzebne do realizacji Zamówienia, a w szczególności: imię i nazwisko, miejsce zamieszkania oraz adres e-mail.
  6. Informacja na temat całkowitej wartości Zamówienia podawana jest każdorazowo przez Sprzedawcę poprzez poinformowanie w drodze wiadomości elektronicznej wraz z informacją, że zawarcie przez Klienta Umowy sprzedaży pociąga za sobą obowiązek zapłaty za zamówiony Towar, z tą chwilą zostaje zawarta Umowa sprzedaży.
  7. W przypadku Klienta będącego Konsumentem, Sprzedawca każdorazowo po złożeniu Zamówienia za pośrednictwem poczty elektronicznej przesyła Klientowi potwierdzenie warunków złożonego Zamówienia.
  8. Umowa zostaje zawarta z chwilą przesłania przez Klienta, będącego Konsumentem (w odpowiedzi na potwierdzenie warunków Zamówienia przesłanych przez Sprzedawcę) wiadomości elektronicznej na adres poczty elektronicznej Sprzedawcy, w której Klient: akceptuje treść przesłanego Zamówienia i wyraża zgodę na jego realizację oraz akceptuje treść Regulaminu i potwierdza zapoznanie się z pouczeniem o odstąpieniu od Umowy.
  9. Umowa sprzedaży zawierana jest w języku polskim, o treści zgodnej z Regulaminem.

V. Dostawa

  1. Dostawa Towarów jest ograniczona do terytorium Rzeczypospolitej Polskiej.
  2. Klient może wybrać następujące formy dostawy zamówionych Towarów:
    1. za pośrednictwem kuriera InPost (19,99 zł)
    2. dostawa do Paczkomat® InPost (16,99 zł)
  3. Sprzedawca na stronach internetowych Sklepu w opisie Towaru informuje Klienta o liczbie Dni roboczych potrzebnych do realizacji Zamówienia i jego dostawy, a także o wysokości opłat za dostawę Towaru.
  4. Termin dostawy i realizacji Zamówienia liczony jest w Dniach roboczych zgodnie z pkt. VI ppkt. 2.
  5. Sprzedawca, zgodnie z wolą Klienta, dostarcza wraz z Towarem paragon fiskalny obejmującąy dostarczane Towary.
  6. Jeżeli dla Towarów objętych Zamówieniem przewidziano różny okres realizacji, dla całego Zamówienia obowiązuje okres najdłuższy spośród przewidzianych.

VI. Ceny i metody płatności

  1. Ceny Towarów podawane są w złotych polskich i zawierają wszystkie składniki, w tym podatek VAT, cła oraz inne opłaty.
  2. Klient może wybrać następujące metody płatności:
    1. przelew bankowy na rachunek bankowy Sprzedawcy (w tym przypadku realizacja Zamówienia rozpoczęta zostanie po przesłaniu Klientowi przez Sprzedawcę potwierdzenia przyjęcia Zamówienia, zaś wysyłka dokonana zostanie niezwłocznie po wpłynięciu środków na rachunek bankowy Sprzedawcy i skompletowaniu Zamówienia);
    2. Podmiotem świadczącym obsługę płatności online w zakresie płatności kartami jest Autopay S.A. Dostępne formy płatności: Karty płatnicze: Visa, Visa Electron, Mastercard, MasterCard Electronic, Maestro.
    3. W przypadku wyboru przez Klienta sposobu płatności przelewem, płatności elektroniczne lub kartą płatniczą – od dnia uznania rachunku bankowego Sprzedawcy. W przypadku wystąpienia konieczności zwrotu środków za transakcję dokonaną przez klienta kartą płatniczą sprzedający dokonana zwrotu na rachunek bankowy przypisany do karty płatniczej Zamawiającego.
  3. Sprzedawca na stronach internetowych Sklepu informuje Klienta o terminie w jakim jest on zobowiązany dokonać płatności za Zamówienie. W przypadku braku płatności przez Klienta w terminie, o którym mowa w zdaniu poprzednim, Sprzedawca po uprzednim bezskutecznym wezwaniu do zapłaty z wyznaczeniem stosownego terminu może odstąpić od Umowy na podstawie art. 491 Kodeksu Cywilnego.

VII. Uprawnienie do odstąpienia od Umowy

  1. Klient, który zawarł umowę na odległość lub umowę poza lokalem przedsiębiorstwa, ma prawo odstąpić od niej bez podawania przyczyny w terminie 14 dni. Do zachowania tego terminu wystarczy wysłanie oświadczenia przed jego upływem.
  2. Klient może sformułować oświadczenie samodzielnie bądź skorzystać ze wzoru oświadczenia o odstąpieniu od Umowy, który stanowi Załącznik nr 1 do Regulaminu.
  3. Termin 14-dniowy liczy się od dnia, w którym nastąpiło dostarczenie Towaru lub w przypadku Umowy o świadczenie Usług od dnia jej zawarcia.
  4. Sprzedawca z chwilą otrzymania oświadczenia o odstąpieniu od Umowy przez Konsumenta prześle na adres poczty elektronicznej Konsumenta potwierdzenie otrzymania oświadczenia o odstąpieniu od Umowy.
  5. Prawo do odstąpienia od Umowy przez Konsumenta jest wyłączone w przypadku:
    1. świadczenia usług, jeżeli Sprzedawca wykonał w pełni usługę za wyraźną zgodą Konsumenta, który został poinformowany przed rozpoczęciem świadczenia, że po spełnieniu świadczenia przez Sprzedawcę utraci prawo odstąpienia od Umowy;
    2. Umowy, w której cena lub wynagrodzenie zależy od wahań na rynku finansowym, nad którymi Sprzedawca nie sprawuje kontroli, i które mogą wystąpić przed upływem terminu do odstąpienia od Umowy;
    3. Umowy, w której przedmiotem świadczenia jest Towar nieprefabrykowany, wyprodukowany według specyfikacji Konsumenta lub służący zaspokojeniu jego zindywidualizowanych potrzeb;
    4. Umowy, w której przedmiotem świadczenia jest Towar ulegający szybkiemu zepsuciu lub mający krótki termin przydatności do użycia;
    5. Umowy, w której przedmiotem świadczenia jest Towar dostarczany w zapieczętowanym opakowaniu, którego po otwarciu opakowania nie można zwrócić ze względu na ochronę zdrowia lub ze względów higienicznych, jeżeli opakowanie zostało otwarte po dostarczeniu;
    6. Umowy, w której przedmiotem świadczenia są Produkty, które po dostarczeniu, ze względu na swój charakter, zostają nierozłącznie połączone z innymi rzeczami;
    7. Umowy, w której przedmiotem świadczenia są napoje alkoholowe, których cena została uzgodniona przy zawarciu Umowy Sprzedaży, a których dostarczenie może nastąpić dopiero po upływie 30 dni i których wartość zależy od wahań na rynku, nad którymi Sprzedawca nie ma kontroli;
    8. Umowy, w której Konsument wyraźnie żądał, aby Sprzedawca do niego przyjechał w celu dokonania pilnej naprawy lub konserwacji; jeżeli Sprzedawca świadczy dodatkowo inne usługi niż te, których wykonania Konsument żądał, lub dostarcza Towary inne niż części zamienne niezbędne do wykonania naprawy lub konserwacji, prawo odstąpienia od Umowy przysługuje Konsumentowi w odniesieniu do dodatkowych usług lub Towarów;
    9. Umowy, w której przedmiotem świadczenia są nagrania dźwiękowe lub wizualne albo programy komputerowe dostarczane w zapieczętowanym opakowaniu, jeżeli opakowanie zostało otwarte po dostarczeniu; dostarczanie dzienników, periodyków lub czasopism, z wyjątkiem Umowy o prenumeratę;
    10. Umowy zawartej w drodze aukcji publicznej;
    11. Umowy o świadczenie usług w zakresie zakwaterowania, innych niż do celów mieszkalnych, przewozu rzeczy, najmu samochodów, gastronomii, usług związanych z wypoczynkiem, wydarzeniami rozrywkowymi, sportowymi lub kulturalnymi, jeżeli w umowie oznaczono dzień lub okres świadczenia usługi;
    12. Umowy o dostarczanie treści cyfrowych, które nie są zapisane na nośniku materialnym, jeżeli spełnianie świadczenia rozpoczęło się za wyraźną zgodą Konsumenta przed upływem terminu do odstąpienia od Umowy i po poinformowaniu go przez Sprzedawcę o utracie prawa odstąpienia od Umowy.
  6. W przypadku odstąpienia od Umowy zawartej na odległość, Umowa jest uważana za niezawartą. To, co strony świadczyły, ulega zwrotowi w stanie niezmienionym, chyba że zmiana była konieczna w celu stwierdzenia charakteru, cech i funkcjonalności Towaru. Zwrot powinien nastąpić niezwłocznie, nie później niż w terminie 14 dni. Zakupiony Towar należy zwrócić na adres Sprzedawcy.
  7. Sprzedawca niezwłocznie, jednak nie później niż w terminie 14 dni od dnia otrzymania oświadczenia Konsumenta o odstąpieniu od Umowy zwróci Konsumentowi wszystkie dokonane przez niego płatności, w tym koszty dostarczenia Towaru. Sprzedawca dokonuje zwrotu płatności przy użyciu takiego samego sposobu zapłaty, jakiego użył Konsument, chyba, że Konsument wyrazi zgodę na inny sposób zwrotu, przy czym sposób ten nie będzie się wiązał dla Konsumenta z żadnym kosztem. Sprzedawca może wstrzymać się ze zwrotem płatności otrzymanych od Klienta do chwili otrzymania rzeczy z powrotem lub dostarczenia przez Klienta dowodu jej odesłania, w zależności od tego, które zdarzenie nastąpi wcześniej, chyba że Sprzedawca zaproponował, że sam odbierze rzecz od Klienta.
  8. Jeżeli Konsument wybrał sposób dostarczenia Towaru inny niż najtańszy zwykły sposób dostarczenia oferowany przez Sprzedawcę, Sprzedawca nie jest zobowiązany do zwrotu Konsumentowi poniesionych przez niego dodatkowych kosztów.
  9. Klient ponosi tylko bezpośredni koszt zwrotu Towaru, chyba że Sprzedawca zgodził się ponieść ten koszt.

VIII. Reklamacje dotyczące Towarów z tytułu rękojmi

  1. Sprzedawca zobowiązuje się dostarczyć Towar bez wad.
  2. Sprzedawca odpowiada wobec Klienta będącego Konsumentem z tytułu rękojmi za wady na zasadach określonych w art. 556 – 576 Kodeksu Cywilnego. W stosunku do Klientów będących Przedsiębiorcami rękojmia zostaje wyłączona.
  3. Reklamacje, wynikające z naruszenia praw Klienta gwarantowanych prawnie, lub na podstawie niniejszego Regulaminu, należy kierować na adres POLKA Katarzyna Krajewska-Sycz ul. Łokietkówny 7/9 92-418 Łódź, na adres poczty elektronicznej: kontakt@lazydaisy.eu, numer telefonu: 515106188.
  4. Celem rozpatrzenia reklamacji Klient powinien przesłać lub dostarczyć reklamowany Towar, jeżeli jest to możliwe dołączając do niego dowód zakupu. Towar należy dostarczyć lub przesłać na adres wskazany w pkt. 3.
  5. Sprzedawca zobowiązuje się do rozpatrzenia każdej reklamacji w terminie do 14 dni.
  6. W przypadku braków w reklamacji Sprzedawca wezwie Klienta do jej uzupełnienia w niezbędnym zakresie niezwłocznie, nie później jednak niż w terminie 7 dni, od daty otrzymania wezwania przez Klienta.

IX. Reklamacje w zakresie świadczenia usług drogą elektroniczną

  1. Klient może zgłaszać Sprzedawcy reklamacje w związku z funkcjonowaniem Sklepu i korzystaniem z Usług. Reklamacje można zgłaszać pisemnie na adres: POLKA Katarzyna Krajewska-Sycz ul. Łokietkówny 7/9 92-418 Łódź, na adres poczty elektronicznej: kontakt@lazydaisy.eu, numer telefonu: 515106188.
  2. W reklamacji Klient powinien podać swoje imię i nazwisko, adres do korespondencji, rodzaj i opis zaistniałego problemu.
  3. Sprzedawca zobowiązuje się do rozpatrzenia każdej reklamacji w terminie do 14 dni, a gdyby to nie było możliwe, do poinformowania w tym okresie Klienta, kiedy reklamacja zostanie rozpatrzona. W przypadku braków w reklamacji Sprzedawca wezwie Klienta do jej uzupełnienia w niezbędnym zakresie w terminie 7 dni, od daty otrzymania wezwania przez Klienta.

X. Gwarancje

  1. Towary mogą posiadać gwarancję producenta, Sprzedawcy lub importera.
  2. W wypadku Towarów objętych gwarancją, informacja dotycząca istnienia i treści gwarancji oraz czasu na jaki została udzielona jest każdorazowo prezentowana w opisie Towaru na stronach internetowych Sklepu.

XI. Pozasądowe sposoby rozstrzygania reklamacji i dochodzenia roszczeń

  1. Klient będący Konsumentem posiada m.in. następujące możliwości skorzystania z pozasądowych sposobów rozpatrywania reklamacji i dochodzenia roszczeń:
    1. jest uprawniony do zwrócenia się do stałego polubownego sądu konsumenckiego działającego przy Inspekcji Handlowej z wnioskiem o rozstrzygnięcie sporu wynikłego z zawartej Umowy sprzedaży;
    2. jest uprawniony do zwrócenia się do wojewódzkiego inspektora Inspekcji Handlowej z wnioskiem o wszczęcie postępowania mediacyjnego w sprawie polubownego zakończenia sporu między Klientem a Sprzedawcą;
    3. może uzyskać bezpłatną pomoc w sprawie rozstrzygnięcia sporu między Klientem a Sprzedawcą, korzystając także z bezpłatnej pomocy powiatowego (miejskiego) rzecznika konsumentów lub organizacji społecznej, do której zadań statutowych należy ochrona Konsumentów (m.in. Federacja Konsumentów, Stowarzyszenie Konsumentów Polskich). Porady udzielane są pod przez Federację Konsumentów pod bezpłatnym numerem infolinii konsumenckiej 800 007 707 oraz przez Stowarzyszenie Konsumentów Polskich pod adresem email porady@dlakonsumentow.pl;
    4. złożyć swoją skargę za pośrednictwem unijnej platformy internetowej ODR, dostępnej pod adresem: http://ec.europa.eu/consumers/odr/.

XII. Ochrona danych osobowych

Podane przez Klientów dane osobowe Sprzedawca zbiera i przetwarza zgodnie z obowiązującymi przepisami prawa oraz zgodnie z Polityką Prywatności, która stanowi Załącznik nr 2 do Regulaminu.

XIII. Postanowienia końcowe

  1. Wszelkie prawa do Sklepu Internetowego, w tym majątkowe prawa autorskie, prawa własności intelektualnej do jego nazwy, domeny internetowej, strony internetowej Sklepu Internetowego, a także do formularzy, logotypów należą do Sprzedawcy, a korzystanie z nich może następować wyłącznie w sposób określony i zgodny z Regulaminem.
  2. Rozstrzyganie ewentualnych sporów powstałych pomiędzy Sprzedawcą a Klientem, który jest Konsumentem, zostaje poddane sądom właściwym zgodnie z postanowieniami właściwych przepisów Kodeksu postępowania cywilnego.
  3. Rozstrzyganie ewentualnych sporów powstałych pomiędzy Sprzedawcą a Klientem, który jest Przedsiębiorcą zostaje poddane sądowi właściwemu ze względu na siedzibę Sprzedawcy.
  4. W sprawach nieuregulowanych w niniejszym Regulaminie mają zastosowanie przepisy Kodeksu Cywilnego, przepisy Ustawy o świadczeniu usług drogą elektroniczną, przepisy Ustawy o prawach Konsumenta oraz inne właściwe przepisy prawa polskiego.
  5. O wszelkich zmianach niniejszego Regulaminu każdy Klient zostanie poinformowany poprzez informacje na stronie głównej Sklepu Internetowego zawierającej zestawienie zmian i termin ich wejścia w życie. Klienci posiadający Konto zostaną dodatkowo poinformowani o zmianach wraz z ich zestawieniem na wskazany przez nich adres poczty elektronicznej. Termin wejścia w życie zmian nie będzie krótszy niż 14 dni od dnia ich ogłoszenia. W razie, gdy Klient posiadający Konto Klienta, nie akceptuje nowej treści Regulaminu obowiązany jest zawiadomić o tym fakcie Sprzedawcę w ciągu 14 dni od daty poinformowania o zmianie Regulaminu. Zawiadomienie Sprzedawcy o braku akceptacji nowej treści Regulaminu skutkuje rozwiązaniem Umowy.

I. General provisions



These Regulations set out the general terms and conditions, the manner of providing electronic services and sales conducted via the www.lazydaisy.eu Internet Shop. The shop is operated by Katarzyna Krajewska-Sycz conducting business activity under the name POLKA Katarzyna Krajewska-Sycz entered into the register of entrepreneurs of the Central Register of Entrepreneurial Activity and Information kept by the Minister of Development at Łokietkówny 7/9 92-418 Łódź, NIP (The Tax Identification Number):7282556627, REGON (Company Registration Number):100690800, hereinafter referred to as the Seller.

These Terms and Conditions are permanently available on the website www.lazydaisy.eu, in a way that makes it possible to obtain, reproduce and record their content by printing or saving on a given device at any time.


The Seller hereby informs that the use of services provided electronically may involve a risk on the part of each Internet user consisting in the possibility of introducing harmful software to the Client’s IT system and obtaining and modifying its data by unauthorised persons. In order to avoid the risk of the aforementioned threats, the Customer should use appropriate technical measures to minimise their occurrence, in particular anti-virus software and a firewall.

II. Definitions



The terms used in the Rules and Regulations are defined as follows:



Working days – weekdays from Monday to Friday excluding public holidays;


Customer – a natural person with full legal capacity, a natural person running a business, a legal person or an organisational unit that is not a legal person, to which specific provisions grant legal capacity, who places an Order within the framework of the Internet Shop or uses other Services available in the Internet Shop;


Civil Code – the Act of 23 April 1964 (Journal of Laws No. 16, item 93 as amended);


Consumer – a Customer who is a consumer within the meaning of Article 22[1] of the Civil Code;


Entrepreneur – a Customer who is an entrepreneur within the meaning of Article 43[1] of the Civil Code;


Terms and Conditions – the present document;


Products – a product presented in the Online Shop, the description of which is available along with each of the presented products;


Sales Contract – a contract of sale of Products within the meaning of the Civil Code, concluded between the Seller and the Customer;


Services – services provided by the Seller to the Customers electronically within the meaning of the Act of 18 July 2002 on provision of electronic services (Journal of Laws No. 144, item 1204 as amended);


Consumer Rights Act – the Act of 30 May 2014 on consumer rights (Journal of Laws 2014, No. 827);


Act on the provision of services by electronic means – the Act of 18 July 2002 on the provision of services by electronic means (Journal of Laws No. 144, item 1204 as amended);


Order – the Customer’s declaration of will, aiming directly at the conclusion of the Sales Agreement, specifying in particular the type and number of Products.

III. Rules of using the Internet Shop

The use of the Internet Shop is possible on condition that the ICT system used by the Customer meets the following minimum technical requirements:

– computer or mobile device with the Internet connection,

– e-mail access,

– Internet Explorer web browser version 11 or newer, Firefox version 28.0 or newer, Chrome version 32 or newer, Opera version 12.17 or newer, Safari version 1.1 or newer,

– cookies and Javascript enabled in your web browser.

The use of the Online Shop is understood as any action taken by the Customer which leads to him/her becoming acquainted with the content contained in the Shop.

In particular, the Customer is required:

– not to provide or transmit content which is prohibited by law, e.g. content which promotes violence, is defamatory or violates personal rights and other rights of third parties,

– use the Internet Shop in a way that is not disruptive to its operation, in particular through the use of specific software or devices,

– not to undertake such actions as: sending or placing unsolicited commercial information (SPAM) within the scope of the Internet Shop,

– use the Internet Shop in a manner that is not burdensome for other Customers and the Seller,

– use any content placed within the scope of the Internet Shop only for own personal use,

– use the Internet Store in a manner which is in accordance with the provisions of the law in force in the Republic of Poland, the provisions of the Terms and Conditions and the general principles of the Internet use.

The Seller has the right to organise occasional contests and special offers, the terms of which will be specified each time on the Store’s website. Promotions in the Internet Store are not cumulative, unless the Regulations of a given promotion state otherwise.

If the Customer violates the provisions of these Terms and Conditions, the Seller, after an ineffective call to cease or remove the violations, setting an appropriate time limit, may terminate the contract for the provision of Services within 14 days’ notice.

IV. Procedure for the conclusion of a Sales Agreement

1. Information about the Products given on the websites of the Shop, in particular their descriptions, technical and usable parameters and prices, constitute an invitation to conclude a Contract, within the meaning of Article 71 of the Civil Code.

2. All Products available in the Online Store are brand new, free from physical and legal defects and have been legally introduced into the Polish market.

3. The condition for placing an Order is to have an active e-mail account.

4. In the case of placing an Order via the Order form available on the website of the Online Store, the Order is submitted to the Seller by the Customer in electronic form and constitutes an offer to conclude a Sales Agreement for the Products which are the subject of the Order. An offer made in electronic form binds the Customer if the Seller sends to the e-mail address provided by the Customer a confirmation of acceptance for the execution of the Order, which constitutes a statement of the Seller on approval of the Customer’s offer and upon its receipt by the Customer a Contract of Sale is concluded.

5. Placing an Order at the Online Shop by sending an electronic message takes place on the Working Days and hours indicated on the Online Shop website. For this purpose the Customer should:

        a. specify the name of the Products from among the Products on the website of the Internet Shop and its quantity in the content of the electronic message addressed to the Seller ,

        b. indicate the manner of delivery and method of payment from among the methods of delivery and payment specified on the website of the Store,

        c. provide the data necessary for the fulfilment of the Order, in particular: first and last name, place of residence and e-mail address.

6. Information regarding the total value of the Order is given each time by the Seller by means of informing the customer via e-mail – along with information that the conclusion of the Contract of Sale by the Customer involves the obligation to pay for the ordered Products. At that moment the Contract of Sale is concluded.

7. In the case of a Customer who is a Consumer, the Seller sends a confirmation of the terms of the Order placed to the Customer via e-mail each time after placing the Order.

8. The Agreement is concluded upon the sending by the Customer who is a Consumer (in response to confirmation of the terms of the Order sent by the Seller) of an electronic message to the e-mail address of the Seller, in which the Customer accepts the content of the sent Order, agrees to its execution, accepts the content of the Regulations and confirms reading the instruction on withdrawing from the Agreement.

9. The Contract of Sale is concluded in the Polish language, with the content compliant with the Terms and Conditions.

V. Delivery

Delivery of the Products is limited to the territory of the Republic of Poland.

The Customer may choose the following forms of delivery of the ordered Products: through a courier company or through a postal service provider.

On the website of the Store,  in the description of the Products the Seller informs the Client about the number of working Days required for execution of the Order and its delivery, as well as the amount of fees charged for delivery of the Products.

The period for delivery and fulfilment of the Order is counted in Working Days in accordance with pt. VI section 2.

The Seller shall, at the Customer’s request, provide a fiscal receipt covering the Products supplied together with the Products.

If different lead times are provided for the Products covered by the Order, the longest period provided for shall apply to the entire Order.

VI. Prices and payment methods

The prices of the Products are given in Polish zloty and include all components: VAT, customs and other necessary charges.

The Client may choose the following methods of payment:

– bank transfer to the Seller’s bank account (in this case, the processing of the Order shall be commenced after the Seller has sent the Client a confirmation of acceptance of the Order, and shipment shall be carried out immediately after the funds have been credited to the Seller’s bank account and the Order has been completed);

– electronic payment by Blue Media S.A with its registered office in Sopot, ul. Haffnera 6, postal code: 81-717, KRS: 0000320590 (in this case the processing of the Order will commence after the Seller has sent a confirmation of acceptance of the Order to the Customer and after the Seller has received information from the system of the payment agent that the payment has been made by the Client, and dispatch will take place immediately after completion of the Order).

– payment by card (Visa, Visa Electron, MasterCard, MasterCard Electronic, Maestro) handled by the company Blue Media S.A with its registered seat in Sopot, ul. Haffnera 6, postal code: 81-717, KRS: 0000320590 (in this case the processing of the Order shall be commenced after obtaining positive authorisation of the payment). If there is a need to refund the funds for a transaction made by the customer with a payment card, the Seller shall make the refund to the bank account assigned to the payment card of the Ordering Party.

On the Shop’s website, the Seller shall inform the Customer about the payment deadline for the Order. If the Customer fails to pay within the period referred to in the preceding sentence, the Seller, after an ineffective calls for payment setting an appropriate time limit, may withdraw from the Contract on the basis of Article 491 of the Civil Code.

VII. The right of withdrawal

The Customer, who is a Consumer, may withdraw from the Contract without giving any reason by making a declaration to that effect within 14 days. Sending the declaration before this deadline is sufficient to meet the deadline.

The Customer may formulate the declaration on his or her own or use the model declaration of withdrawal from the Agreement, which constitutes Attachment No. 1 to the Terms and Conditions.

The 14-day term shall be counted since the very day the Products were delivered or, in the case of the Contract for Services, since the very day of its conclusion.

Upon receipt of the Consumer’s declaration of withdrawal from the Contract, the Seller shall send a confirmation of receipt of the declaration of withdrawal to the Consumer’s e-mail address.

The Consumer’s right to withdraw from the Contract is excluded in the case of:

a) the provision of services, if the Seller has performed the service in full with the express consent of the Consumer, who has been informed before the start of the performance that after the Seller’s performance he will lose the right to withdraw from the Agreement;

b) the Agreement in which the price or remuneration depends on fluctuations in the financial market, over which the Seller does not have control, and which may occur before the expiry of the deadline for withdrawal from the Agreement;

c) the Agreement in which the object of purchase is a non-refabricated Product manufactured exclusively for the Consumer with specifications or serving that would meet the Consumer’s individual needs;

d) the Agreement in which the object of service is an item which deteriorates rapidly or has a short shelf life;

e) the Agreement in which the object of performance is the Product supplied in sealed packaging which cannot be returned after opening the packaging for health or hygiene reasons, if the packaging has been opened after delivery;

f) the Agreement in which the subject matter of the service is the Product which after delivery, due to its nature, is inseparably combined with other things;

g) the Agreement in which the subject of the service are alcoholic beverages, the price of which has been agreed upon at the conclusion of the Sales Contract, the delivery of which may only take place after 30 days and the value of which depends on fluctuations in the market over which the Seller has no control;

h) the Agreement in which the Consumer expressly requested that the Seller come to him to carry out urgent repair or maintenance; if the Seller performs any additional services than those, the service of which the Consumer requested, or supplies Products other than spare parts necessary for the service of repair or maintenance, the right of withdrawal shall be vested in the Consumer in respect of additional services or Products;

i) the Agreement in which the subject matter of the performance is a sound or visual recording or computer software supplied in sealed packaging if the packaging has been opened after delivery; supply of newspapers, periodicals or magazines, except for a subscription contract;

j) the Agreement concluded by means of a public auction;

k) the Agreement for the provision of accommodation other than the one for residential purposes, carriage of Products, car rental, catering, services related to leisure, entertainment, sports or cultural events, if the contract stipulates a day or period of service;

Agreements for the supply of digital content which is not recorded on a tangible medium, if the performance has begun with the consumer’s expressed consent before the expiry of the deadline for withdrawal from the Agreement and after the Seller has informed the consumer of the loss of the right to withdraw from the Agreement.

In the case of withdrawal from the Agreement concluded at a distance, it shall be deemed not to have been concluded. What the parties have provided shall be returned unchanged, unless the change was necessary to ascertain the nature, characteristics and functionality of the Product. The return should take place immediately, no later than within 14 days. The purchased Product should be returned to the Seller’s address.

The Seller shall promptly, but not later than within 14 days from the date of receipt of the Consumer’s declaration of withdrawal from the Contract, return all payments made by the Consumer, including the costs of delivery of the Products to the Customer. The Seller shall reimburse the payment using the same method of payment used by the Consumer, unless the Consumer agrees to a different method of reimbursement, which method shall not involve any cost to the Consumer. The Seller may withhold reimbursement of the payment received from the Consumer until it has received the item back or the Consumer has provided proof of its return, whichever event occurs first, unless the Seller has offered to collect the item from the Consumer itself.

If the Consumer has chosen a method of delivery of the Product other than the cheapest ordinary means of delivery offered by the Seller, the Seller shall not be obliged to reimburse the Consumer for any additional costs incurred by the Consumer.

The Customer shall only bear the direct cost of returning the Product, unless the Seller has agreed to cover this cost.

VIII. Complaints concerning Products under warranty

The Seller is obliged to deliver Products without defects to the Customer.

The Seller shall be liable to the Customer who is a Consumer on account of the warranty for any possible flaws under the principles specified in Articles 556 – 576 of the Civil Code. In relation to Customers who are Entrepreneurs, the warranty is excluded.

Complaints resulting from a breach of the Customer’s rights guaranteed by law or on the basis of these Regulations should be sent to POLKA Katarzyna Krajewska-Sycz at ul. Łokietkówny 7/9 92-418 Łódź, to the following e-mail address: kontakt@lazydaisy.eu or reported via telephone number: 515106188.

In order to consider the complaint, the Customer should send or deliver the Products under complaint, if possible enclosing the proof of purchase. The Products should be delivered or sent to the address indicated in point. 3.

The Seller is obliged to consider each complaint within 14 days.

In the case of deficiencies in the complaint, the Seller shall immediately inform the Customer to supplement it to the extent necessary, but no later than within 7 days from the date of receipt of the call by the Customer.

IX. Complaints regarding provision of services by electronic means

The Customer may submit complaints to the Seller in relation to the functioning of the Shop and the use of the Services. Complaints may be submitted in writing to the address: POLKA Katarzyna Krajewska-Sycz ul. In the complaint, the Customer should provide his/her name, correspondence address, type and description of the problem.

The Seller is obliged to consider each complaint within 14 days, and if this is not possible, to inform the Customer within this period about the timing needed for the complaint to be considered. In the case of deficiencies in the complaint, the Seller shall inform the Customer to supplement the complaint to the extent necessary within 7 days from the date of receipt of the call by the Customer.

X. Warranties

The Products may have the guarantee of the manufacturer, Seller or importer.

In the case of Products covered by a guarantee, information as to the existence and content of the guarantee and the period for which it is granted is presented in the description of the Product on the website of the Store.

XI. Out-of-court complaint and claim settlement methods

A Customer who is a Consumer has, inter alia, the following possibilities of using out-of-court ways of dealing with complaints and pursuing claims:

a) is entitled to apply to a permanent amicable consumer court operating at the Trade Inspection with a request to resolve a dispute arising from the concluded Sales Agreement;

b) is entitled to apply to the regional inspector of the Trade Inspection to initiate mediation proceedings for the amicable settlement of a dispute between the Customer and the Seller;

c) may obtain free-of-charge assistance in resolving a dispute between a Customer and a Seller, using also free-of-charge assistance of a county (city) consumer ombudsman or a social organisation whose statutory tasks include consumer protection (e.g. Federation of Consumers, Polish Consumers Association). Advice is provided by the Federation of Consumers at the toll-free consumer helpline number 800 007 707 and by the Association of Polish Consumers at the email address porady@dlakonsumentow.pl;

d) submit their complaint via the EU ODR online platform, available at: http://ec.europa.eu/consumers/odr/.

XII. Personal data protection

The Seller collects and processes the personal data provided by the Customers in accordance with the applicable legal regulations and in accordance with the Privacy Policy, which constitutes Appendix No. 2 to the Terms and Conditions.

XIII. Final provisions

All rights to the On-line shop, including property copyright, intellectual property rights to its name, Internet domain, the On-line shop website, as well as to the forms or logotypes belong to the Seller, and their use may be performed only in the manner specified and compliant with the Terms and Conditions.

Any disputes arising between the Seller and the Customer, who is a Consumer, shall be settled by the competent courts in accordance with the provisions of the relevant provisions of the Code of Civil Procedure.

Any disputes arising between the Seller and a Customer who is an Entrepreneur are referred to the competent court for the seat of the Seller.

In other matters that are not regulated in Terms and Conditions, the provisions of the Civil Code, the provisions of the Act on Providing Services by Electronic Means, the provisions of the Act on Consumer Rights and other relevant provisions of Polish law shall apply.

Each Customer shall be informed of any amendments to these Terms and Conditions by means of information on the main page of the Internet Shop containing a summary of the amendments and the date on which they become effective. Customers who have an Account shall additionally be informed of the changes together with a summary thereof sent to the e-mail address indicated by them. The effective date of the changes shall not be shorter than 14 days since the date of their announcement. If the Customer who has an Account does not accept the new content of the Terms and Conditions, he or she is obliged to inform the Seller about this fact within 14 days since the date of informing about the changes to the Terms and Conditions. Notifying the Seller about the lack of acceptance of the new content of the Terms and Conditions shall result in termination of the Agreement.
